The privacy of your personal information is important to us. This Privacy Notice describes the data privacy practices with respect to personal data EverVault Concierge LLC (“EverVault”) collects from and about you, including when you visit our website (the “site”) where this Privacy Notice is posted. References in this Privacy Notice to “we,” “us,” or “our,” are references to EverVault.  Please read this Privacy Notice carefully. When you use the site, you agree to the use of your personal data by EverVault as outlined in this Privacy Notice. This Privacy Notice may change from time to time. Your continued use of the site after we make changes is deemed to be an acceptance of those changes. Please check the Privacy Notice periodically for updates.

1. PERSONAL DATA WE COLLECT

Categories of personal data collected: The data we collect depends on your interaction with the site, and your use of certain functions and features on the site.  The following are the general categories of personal data we may collect from you or about you:

·        Name and contact information. We may collect your first and last name, email address, postal address, phone number, and other similar contact data.

·        Credentials. We process passwords and related security information used for authentication and account access and security purposes.

·        Usage data. We collect information about your use of the site and online services to better understand their use, identify potential improvements, and to send you marketing and promotional communications tailored to you.

·        Web requests. We collect site use information such as timestamps, exception messages, user agent, IP address, and request time and duration. When this is associated with you, it will be treated as personal data and subject to this Privacy Notice.

·        Location data. We collect your IP address and associate this with you to infer your location, such as city or postcode, to provide you with online services, to communicate with you, and for relationship management purposes.

·        Content. We may collect the content you send to us.

Sources of personal data: EverVault collects these categories of personal data about you from the following sources:

·        Information that you or your authorized representative provides when you sign up for and/or use our sites or otherwise engage with us. This information may be provided directly by you or indirectly through your authorized representative.

·        Information from other sources. We collect personal data about you from alternative sources, for example your representative, your employer, or a publicly available source.

·        Information collected through social media. We collect personal data about you when you click on advertisements we place on third party social media platforms or services, such as Facebook and LinkedIn.

·        Information collected through tracking and automated means. We use cookies, web beacons, and other technologies to track or automatically collect certain information when you use our sites. For information on our cookie data collection practices, see Section 7.

 

 

2. HOW WE USE YOUR PERSONAL DATA

We will only use your personal data as permitted by law. We use your personal data for a variety of purposes, including to:

·        Provide you with access to certain areas and features of the site requested by you or on your behalf;

·        Provide you with our products or services requested by you or on your behalf;

·        Address any problems in the site and protect the security and integrity of online services;

·        Perform any legal obligation owed to you, including for performance of any legal contract with you or for your benefit; and

·        Protect the confidentiality, rights, property, or safety of us or any other person, the content of the site, and our operations.

We may use your personal data for any other purposes disclosed at the time you provide your personal data, or otherwise with your consent.  Please note that we may process your personal data without your knowledge or consent, in compliance with the above rules, where it is required or permitted by law.

3. HOW WE SHARE PERSONAL DATA

It is the practice of EverVault to protect users’ information. The information you provide will not be sold or rented to third parties. 

We may share your personal data with third parties:

·        To provide services to us or on our behalf, such as to companies or individuals that host or operate our sites, analyze data, or provide customer service and to our agents, lawyers, consultants, or other advisors.

·        Where we are required by law to disclose personal data and to satisfy regulatory requirements;

·        To protect our property and interest, such as to our attorneys, accountants, regulators, auditors, or other advisors, to respond to emergencies and to protect the rights, property, safety, or security of third parties and visitors to our sites; or

·        With anyone expressly authorized by you to receive your personal data.

Except as provided in this Privacy Notice, we will not provide any of your personal data to any third parties without your specific consent.

4. HOW WE PROTECT YOUR PERSONAL DATA

EverVault is committed to protecting the security of your personal data. We take commercially reasonable technical, physical, and organizational/administrative security measures to protect personal data from accidental loss or destruction, and from unauthorized access, use, misuse, alteration, and disclosure. Unfortunately, no method of transmission over the Internet or method of electronic storage is 100% secure. As a result, we cannot and do not guarantee or warrant the absolute security of any of your personal data.

5. HOW LONG WE KEEP YOUR PERSONAL DATA

We will keep your personal data in accordance with all applicable laws and until such time as we no longer expect we need it for any legal and legitimate purpose. At the appropriate time, we will take reasonable steps to destroy your personal data in a safe manner.

6. YOUR RIGHTS REGARDING YOUR PERSONAL DATA

EverVault respects your right to access and control your personal data. Subject to applicable law, you may exercise the following choices regarding our processing of your personal data:

·        Access. You may request access to your personal data to see what personal data we have collected about you and what personal data about you was disclosed to third parties. Depending on the scope of your request, we may need to verify your identity to process the request and may also charge you a fee for providing you with a copy of your data (except where this is not permissible under applicable law).

·        Correction/Rectification. You may request that your personal data be amended or corrected if you believe there is an inaccuracy.

·        Deletion. You may request that we delete your personal data. Please note that the deletion of your personal data may prevent us from providing you content, services, or other benefits that depend on the processing of your personal data.

·        Objection/Opposition. You can object/oppose to our use of your personal data if you believe such processing is contrary to this Privacy Notice or is otherwise not permitted by applicable law.

·        Data Portability. You may request transmission of your personal data to another data controller in a standard machine-readable format.

·        Withdraw consent. Where we rely on your consent to process your personal data, you may withdraw such consent at any time. We will apply your preferences going forward and this will not affect the lawfulness of the processing before your withdrawal of consent.

Important: The exact scope of these rights vary by state. There are also several exceptions where we may not have an obligation to fulfill your request.

To exercise any of these rights, please submit your request to info@evcpgh.com. To appeal a decision regarding a consumer rights request, submit your appeal to info@evcpgh.com within forty-five (45) days of the issuance of your initial decision.

You may have a right in some locations to file a complaint with your local data protection authority.

7. COOKIES NOTICE

This Cookies Notice describes how we collect and store information through cookies, pixel tags, and local objects (collectively referred to as “Cookies”) on our sites, the reasons we use Cookies, and how you can manage settings related to Cookies.

A. What are Cookies and why does EverVault use them?

A Cookie is a text file stored on your computer, mobile, or other device by your web browser when you visit or use a site, and that your browser provides to us each time you return to the site. Almost every website uses these files. Cookies may store certain information such as your internet protocol (“IP”) address, operating system, device information, browser type and language, referring URLs, access times, pages viewed, links clicked, and other information about your activities or use of the site.  Cookies vary in duration. Session Cookies, for example, last for as long as your internet browser is open. Once the browser closes, the Session Cookies disappear. Persistent Cookies are stored on your device for longer periods. Both types of Cookies can create an identification that is unique to your device.

B. What Types of Cookies does EverVault use?  EverVault may use any of the following types of Cookies on the site.

Strictly Necessary Cookies are essential to make the site perform certain functions and make certain features available to you. These Cookies are used for technical purposes such as enabling better navigation on the site features and content. Without these Cookies, these features cannot be provided or some of its features could be significantly diminished.

Performance Cookies are used for various performance purposes including tracking the number of visitors to the site and information such as the number of views a page gets, how much time a user spends on a page, and other pertinent web statistics. These Cookies are used to improve the performance of the site, their function, and your experience using them.

Functional Cookies enable the site to save information already entered (such as your username, language choices, and location), so it can offer improved and more personalized functions. Functional Cookies are also used to enable features you request, such as playing videos.

Analytics Cookies are used with our sites from third parties, such as Google Analytics. These services use Cookies to collect information such as IP address, device ID, browser information, geolocation, content viewed, or other similar information for the purpose of analyzing and measuring how visitors use the site, interact with advertisements, and measure specific functions and features. These Cookies are linked to a user’s use of that third party’s services. Third-party Cookies are managed by third-party service providers that also provide EverVault with statistical or analytical information and help us provide you with advertisements that we believe would be relevant for you. The information collection and use practices by such third parties are described in that third party’s privacy policies and Cookies notices, not this Cookies Notice.

8. DO NOT TRACK NOTICES

California law requires that we disclose whether we respond to your web browser’s Do Not Track signals. We do not respond to Do Not Track signals at this time.

9. POLICIES APPLICABLE TO CHILDREN

EverVault and the site are not targeted to children under the age of 13, and EverVault does not knowingly collect personally identifiable information from any child under the age of 13 without parental consent. If we become aware that such data has been collected, we will delete it.

10. CHANGES TO THIS PRIVACY NOTICE

We may update this Privacy Notice from time to time, and we will provide notice of any such changes to the policy as required by law. and post the revised notice on our sites. Any changes will be effective immediately upon the posting of the revised Privacy Notice. The date the Privacy Notice was last updated is identified at the top of the page. We will notify you of changes to this policy by updating the “last updated” date and posting the updated policy on the site. You are encouraged to check the site periodically to review any revised Privacy Notice.  Your continued use of our sites after such amendments will be deemed your acknowledgement of these changes to this Privacy Notice.
